This “Privacy Policy” regulates the processing of your personal data by MSE Europe nv, a company incorporated in Belgium, with registered offices in Brucargo, Vliegveld, 749, Steenokkerzeel 1820, Belgium, registered in the register of legal entities under nr. 0860.512.437, and its affiliates, Hereinafter: “MSE Europe”.

1.1. MSE Europe complies with the “Law of 8 December 1992 on the protection of privacy with regard to the processing of personal data”, as amended by the Law of 11 December 1998 as well as the anti-spam provisions of Book XII of the Belgian Code of Economic Law concerning the ” law of the electronic economy “.

Article 2 - Personal data

2.1. Personal data that you communicate to us:

Category 1: without registration and when visiting our website: your IP address and surfing behavior on our website. The entry site you used to reach our website and the search terms you used to find us online;

Category 2: When you contact us as a client, contractor, supplier or prospect: your company name, registered seat and branch office addresses, VAT number and registration number, contact person’s Name, Surname, E-mail address, Log in ID, Log in password (encrypted), function, main office (incl. address), country they are active, office phone number, cell phone number, manager name (N+1), small picture, contact ID, gender, language, bank account, tax reference, amounts incoming and outgoing invoices

3.1. General purposes:

MSE Europe will only use the Personal Data collected by you for the following purposes:

Category 1: the maintenance and improvement of our Website and the inclusion of Personal Data in anonymous statistics, from which the identity of specific persons or companies cannot be determined, based on the legitimate interests of MSE Europe to continuously improve its Website and services;

Category 2 and 3: managing our contracts and contacts with you, providing our services, ensuring follow up;

Category 3: Sending you our newsletter or other communications, answering the message you send us via our contact section, staying in touch with our clients and prospects.

You are not obliged to provide us with your Personal Data, but you must understand that the provision of certain services becomes impossible if you refuse the processing.

MSE Europe may also exchange your data with third parties for administrative, commercial or legal reasons. Such third parties may include other MSE Europe branch offices around the world, software suppliers of the software used by MSE Europe to manage your data (ERP, CRM, Accounting, HR software), transporters, airlines, postal services, airport authorities, customs services, government services, banks, insurance companies, credit card companies and PSP’s, telecom providers, law firms, accountants, leasing companies, all types of Internet service providers and online service providers.

MSE Europe will reasonably attempt to inform you in advance of the fact that MSE Europe will disclose your information to the said third parties, but you also acknowledge that this is not always technically or commercially feasible under all circumstances and that the information above is sufficient to inform you of the possibility of any data transfer we might envision.

MSE Europe will not sell your Personal Data, nor rent, distribute or otherwise make commercially available to third parties, except as described above or with your prior consent.

In certain circumstances, we may be held to export your data outside the European Union because of technical, organizational or legal requirements (pick-up or delivery point outside EU, exchange with our branch offices or our local staff, non-EU based commercial partners, server location for certain services outside EU…). Article 4 - Duration of the processing

All data is stored and processed by us for a period that is necessary depending of the Purpose of the processing and in function of any contractual relationship between MSE Europe and yourself.

Client data is stored until 10 years after the last contact with a client (new order, new offer request, new complaint, newsletter read, presence at event, …

Invoices and financial documents are stored for 10 years.

Article 5 - Your rights

5.1. Right of access and information:

You have the right to receive free access to your personal data at any time, as well as to be informed
of the use we make of your personal data.

5.2. Right of improvement, deletion and limitation of the processing:

You are free to decide not to communicate your personal data to MSE Europe. You also have the right to request us to correct or delete your personal data. You acknowledge that in case of refusal of communication or if you request for the removal of personal data, certain services of the Website may not be available. You may also request to limit the processing of your Personal Data.

5.3. Right to object:

You also have a right of opposition to the processing of your personal data for serious and legitimate
reasons.

In addition, you always have the right to oppose the use of your personal data for direct marketing purposes; in such a case you do not have to provide us with reasons for this demand.

5.4. Right of data portability:

This right is without prejudice is without prejudice of eventual proceedings if you suffer damage as a result of the processing of your personal data, you can submit a claim for compensation with a civil Court.
